HomePerty End User Licence Agreement

Effective date: 24 September 2026

This End User Licence Agreement ("Licence") is a legal agreement between you and KingNerd (Gabriel), an independent developer based in Bucharest, Romania ("we", "us", "our"), for the HomePerty mobile and web application, including its updates, documentation and any content we supply with it (the "App"). By downloading, installing or using the App you accept this Licence. If you do not accept it, do not install or use the App, and delete any copy you hold.

This Licence covers your right to use the software. The HomePerty Terms of Service cover the service around it, meaning accounts, subscriptions, Cloud Backup, Cloud Sync and shared workspaces, and the HomePerty Privacy Policy covers what happens to your data. Where this Licence and the Terms of Service both address the same subject, the Terms of Service prevail for the service and this Licence prevails for the software.

1. Licence granted to you

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App:

on any device you own or control, and
for your own property record keeping, whether personal or in the course of your own business.

The App is licensed to you, not sold. We keep every right this Licence does not expressly give you.

If you obtained the App from Apple's App Store, this licence is also limited by the Usage Rules in Apple's Media Services Terms and Conditions, including the rules on sharing with a family group. If you obtained it from Google Play, it is limited by Google Play's own terms in the same way.

2. What you may not do

You agree not to:

copy the App, except as the normal use of it requires, or distribute, resell, rent, lease, lend or sublicense it;
modify, adapt, translate or create derivative works from it;
reverse-engineer, decompile or disassemble it, or otherwise try to derive its source code, except so far as applicable law expressly permits despite this restriction, and then only within the limits that law sets;
remove, obscure or alter any copyright, trademark or other proprietary notice;
circumvent, disable or tamper with the licensing, entitlement, Cloud Backup or Cloud Sync access controls, or use a licence key you did not receive from us;
use the App to store or process data you have no right to store, or for any unlawful purpose;
interfere with our infrastructure, or attempt to reach another user's data.

3. Free tier, Pro and licence keys

The Free tier includes every feature of the App for a single property, at no cost and with no account.

Pro removes the property limit and unlocks Cloud Backup, Cloud Sync across your own devices, the shared workspace and spreadsheet export. There are two ways to hold it:

A subscription bought through the App Store or Google Play. This is the only way Pro can be purchased. Billing, renewal, cancellation and refunds are handled by that store and are described in the Terms of Service.
A complimentary licence key, which we issue to support cases, press and app reviewers. Keys are not sold and cannot be bought. Each key is single-use and is tied to the activation that redeems it. Keys are non-transferable and may be revoked if we reasonably believe one was obtained fraudulently, shared publicly or resold.

Your Pro entitlement is personal to you. It does not transfer with a device you sell or give away.

4. Ownership

The App, its source code, design, user interface, artwork, name and branding are owned by KingNerd (Gabriel) and are protected by copyright and other laws. This Licence transfers no ownership of any of it.

Your data is yours. Everything you enter into the App, meaning property records, tenant information, financial data, documents and photographs, remains yours. We claim no ownership of it and we do not use it to train models, for advertising, or for any purpose other than providing the features you use. What we hold, when and why is set out in the Privacy Policy.

5. Third-party components

The App includes open-source software supplied by third parties, each under its own licence. You can read the full list inside the App under Settings, About, Open-source licences. Nothing in this Licence limits any right those licences give you, and where one of them conflicts with this Licence for that component, that licence applies to it.

6. Updates

We may release updates, and your device or app store may install them automatically depending on your settings. An update is part of the App and is covered by this Licence. We may change, add or remove features over time. We are not obliged to keep supporting older versions of the App, older operating systems, or any particular feature.

7. Disclaimer of warranties

The App is provided "as is" and "as available", without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, except where such disclaimers are not permitted by applicable law.

HomePerty is a record keeping tool. Its calculators, reports, and tax and depreciation figures are estimates for information only, and they are only as accurate as what you enter. They are not financial, legal, accounting or tax advice. Consult a qualified professional before making a financial, legal or tax decision, and check anything important against your own records.

We do not warrant that the App or any service it depends on, including Google Firebase, Google Maps, the App Store and Google Play, will be uninterrupted, error-free or always available. Cloud Backup and Cloud Sync are conveniences. You remain responsible for keeping your own copies of records that matter to you, and the App can save backup files for exactly that reason. Backup files are not encrypted: anyone who has one can read it, so keep them somewhere private.

8. Limitation of liability

To the maximum extent permitted by applicable law, KingNerd (Gabriel) will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue, profit or goodwill, arising out of or relating to the App or your use of or inability to use it, on any legal theory, even if we have been advised that such damage was possible.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the App will not exceed the amount you actually paid for HomePerty, if any, in the twelve months before the claim arose.

Nothing in this Licence limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your mandatory statutory rights are not affected or restricted by this Licence.

9. Term and termination

This Licence takes effect when you first install or use the App and continues until it ends.

You may end it at any time by uninstalling the App and deleting every copy you hold. If you have an account, you can delete it and your cloud data inside the App: see Delete Your Account & Data.
We may end it if you materially breach it, in particular section 2. Where it is reasonably possible we will give notice first and a chance to put things right.

When this Licence ends you must stop using the App and remove it from your devices. Sections 4, 7, 8, 10 and 13 survive termination. Ending this Licence does not by itself cancel a subscription or entitle you to a refund; cancel through the store that sold it, as described in the Terms of Service.

10. Export and legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export and import laws when using the App.

Encryption. The App contains no encryption of its own. It relies only on the standard encryption built into your device's operating system and web browser, such as HTTPS connections and the secure storage of iOS and Android. Our App Store declaration says the same: the App uses no non-exempt encryption.

11. Age

You must be at least 18 years old to use the App. It is a tool for adults managing real property and finances and it is not directed at children.

12. Changes to this Licence

We may update this Licence. Material changes will be shown by a new effective date at the top of this page and, where appropriate, announced in the App's About screen. If you continue to use the App after a change takes effect, you accept the revised Licence. If you do not accept it, stop using the App and uninstall it.

13. Governing law

This Licence is governed by the laws of Romania, except where mandatory consumer-protection law in your country of residence provides otherwise. Any dispute not settled informally may be brought before the competent Romanian courts, without prejudice to any right you have as a consumer to bring a claim in the courts of your own country of residence under mandatory consumer-protection rules, for example in the EU or the UK.

14. Terms that apply to the App Store version

This section applies only to a copy of the App obtained from Apple's App Store, and it prevails over anything above that conflicts with it.

Not with Apple. This Licence is between you and us only. Apple is not a party to it and is not responsible for the App or its contents.
Scope of licence. Your licence is non-transferable and permits use only on an Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
Maintenance and support. We are solely responsible for any maintenance and support. Apple has no obligation to provide any support for the App. Reach us at hello@homeperty.com.
Warranty. To the maximum extent permitted by applicable law, Apple gives no warranty for the App. If the App fails to conform to any warranty that does apply, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation of any kind, and any other claim, loss, liability, damage, cost or expense arising from a failure to conform to a warranty is our responsibility.
Product claims. We, and not Apple, are responsible for addressing any claim by you or a third party about the App or your use of it, including product liability claims, any claim that the App fails to meet a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law.
Intellectual property. If a third party claims the App infringes their intellectual property rights, we, and not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
Legal compliance. The representations in section 10 apply.
Third-party terms. You must comply with any applicable third-party terms when using the App.
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this Licence. On your acceptance of it, Apple has the right, and is deemed to have accepted the right, to enforce it against you.

15. Terms that apply to the Google Play version

This section applies only to a copy of the App obtained from Google Play.

This Licence is between you and us only. Google is not a party to it and is not responsible for the App. We are solely responsible for maintenance and support. Your use of Google Play is also governed by the Google Play Terms of Service.

16. General

Entire agreement. This Licence, together with the Terms of Service and the Privacy Policy, is the whole agreement between you and us about the App, and replaces any earlier understanding about it.
Severability. If any part of this Licence is held unenforceable, the rest stays in force and the unenforceable part is treated as modified to the least extent needed to make it enforceable.
No waiver. If we do not enforce a right, that is not a waiver of it.
Assignment. You may not assign or transfer this Licence. We may assign it in connection with a merger, acquisition or sale of assets, on notice to you.
